1. Eligibility

QueMation may be used by children as young as 4 years old. Use by children under 13 must be supervised by, and is subject to the consent of, a parent or legal guardian, who accepts these Terms on the child's behalf. Users between 13 and the age of legal majority in their jurisdiction may use the App with the involvement and consent of a parent or legal guardian. By downloading or enabling QueMation on a device for a child, the parent or guardian represents that they have authority to accept these Terms on that child's behalf and agrees to be responsible for the child's use of the App.

2. Description of Service

QueMation is a mobile application that allows users to operate a device's camera through hands-free, gesture-based commands. Features may include gesture recognition for capturing photos and videos, hands-free camera controls, gesture customization, and related functionality (collectively, the "Features"). MadePure Media may add, modify, or remove Features at any time without prior notice.

3. No Account Required; Offline Use

QueMation does not require you to create an account, and no personal registration information is needed to use the App. QueMation is designed to function fully offline — gesture recognition and camera control operate locally on your device without requiring an internet connection. Certain optional Features (such as receiving app updates or support communications) may require internet connectivity, but core Features do not.

4. Camera, Gesture Recognition, and Device Permissions

QueMation requires access to your device's camera and, depending on device capabilities, motion sensors or additional inputs to detect gestures. By enabling these permissions, you consent to the App's use of your camera feed solely for the purpose of providing gesture recognition and camera-control functionality.

• On-device processing. Where technically feasible, gesture recognition is designed to be processed locally on your device. Any exceptions, and details on what data (if any) is transmitted off-device, are described in our Privacy Policy.

• No covert recording. QueMation is designed to activate photo/video capture only in response to user-initiated gestures or explicit in-app controls. You are solely responsible for ensuring your use of the App complies with the consent and privacy expectations of any third parties who may appear in photos or videos you capture.

• Third-party consent. You agree not to use QueMation to photograph or record any person without the legal right or necessary consent to do so, including in jurisdictions with two-party consent or biometric privacy laws.

5. Biometric and Sensor Data

Gesture recognition may involve the processing of movement, hand position, or other biometric-adjacent data solely to interpret gestures for camera control. We do not use this data to identify individuals or build biometric identity profiles. Full details on collection, use, retention, and deletion of this data are set out in our Privacy Policy, which is incorporated into these Terms by reference. Where required by applicable law (e.g., biometric privacy statutes), we will obtain any additional consent necessary before processing such data.

6. License Grant

Subject to your compliance with these Terms, MadePure Media grants you a limited, non-exclusive, non-transferable, revocable license to download and use QueMation on devices you own or control, solely for your personal, non-commercial use, unless otherwise agreed in writing.

You may not:

• Reverse engineer, decompile, or disassemble the App, except where permitted by applicable law;

• Copy, modify, distribute, sell, or lease any part of the App;

• Use the App for any unlawful purpose or in violation of any applicable local, state, national, or international law;

• Use the App to harass, stalk, surveil, or invade the privacy of any individual;

• Circumvent or interfere with any security or gesture-authentication features of the App;

• Use automated means (bots, scrapers) to access the App.

7. User Content

"User Content" means any photos, videos, gesture profiles, or other content you create or capture using QueMation.

• Ownership. You retain all ownership rights in your User Content.

• Local storage only. QueMation stores your User Content locally on your device. We do not access, host, or transmit your User Content, and do not claim any ownership or license in it.

• Your responsibility. You are solely responsible for your User Content and for ensuring you have all necessary rights and consents to capture, store, and share it.

8. Prohibited Conduct

You agree not to:

• Use QueMation to violate any person's privacy, publicity, or intellectual property rights;

• Capture or distribute content that is unlawful, obscene, defamatory, or that depicts minors in an exploitative manner;

• Interfere with the App's operation or security;

• Attempt to tamper with, hack, or reverse engineer the App's gesture-recognition system;

• Use the App in any manner that could disable, overburden, or impair it.

We reserve the right to investigate and take appropriate action for violations of this section.

9. Free Trial and Subscriptions

QueMation offers a free trial that includes 30 free takes (photo/video captures) using the App's gesture-activated Features. After you have used your 30 free takes, continued use of gesture-activated capture requires purchase of a paid subscription.

• Pricing and subscription tiers will be displayed in the App prior to purchase and may change with notice;

• Subscriptions may automatically renew unless canceled prior to the renewal date, in accordance with the applicable app store's policies;

• All purchases are processed through the applicable app store (e.g., Apple App Store, Google Play), and are subject to that platform's payment terms and refund policies;

• Except as required by law, purchases are non-refundable;

• We reserve the right to modify the number of free takes included in the trial, or the features included in any subscription tier, with reasonable notice.

10. Intellectual Property

The App, including its software, gesture-recognition models, design, logos, and trademarks (including "QueMation" and the MadePure Media name and logo), are the property of MadePure Media Corp or its licensors and are protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any ownership rights to you.

11. Third-Party Services

QueMation does not integrate with, connect to, or share data with any third-party services. If you use your device's native sharing functions to send a photo or video from QueMation to another app, that other app's own terms and privacy practices will govern that content — QueMation itself does not transmit your data to any third party.

12. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. MADEPURE MEDIA DOES NOT WARRANT THAT GESTURE RECOGNITION WILL BE ACCURATE, UNINTERRUPTED, OR ERROR-FREE, OR THAT THE APP WILL MEET YOUR REQUIREMENTS. YOU ACKNOWLEDGE THAT GESTURE-BASED CONTROLS MAY MISFIRE OR FAIL TO ACTIVATE, AND YOU ASSUME ALL RISK ARISING FROM RELIANCE ON HANDS-FREE OPERATION.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MADEPURE MEDIA CORP, ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY U.S. DOLLARS ($50).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless MadePure Media Corp and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the App, your User Content, or your violation of these Terms or any rights of a third party.

15. Termination

We may suspend or terminate your access to QueMation at any time, with or without cause or notice, including for violation of these Terms. You may stop using the App and uninstall it at any time. Sections of these Terms that by their nature should survive termination (including Sections 10, 12, 13, 14, and 17) will survive.

16. Changes to the App or Terms

We may update these Terms from time to time. Material changes will be communicated through the App or by other reasonable means. Continued use of QueMation after changes take effect constitutes acceptance of the revised Terms. We may also modify, suspend, or discontinue the App or any Feature at any time.

17. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which MadePure Media Corp is incorporated, without regard to conflict-of-law principles, unless otherwise required by applicable local law. Any disputes arising from these Terms or the App shall first be attempted to be resolved informally by contacting us. 18. Privacy

Our collection and use of personal information, including camera and gesture data, is described in our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully before using the App.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the App, constitute the entire agreement between you and MadePure Media Corp regarding QueMation, superseding any prior agreements.
